What Does New York Health Insurance Law Cover?
Health insurance was created so that people could get quality health care when they needed it. New York has enacted many laws to regulate the health insurance business in the state. These laws greatly protect the residents of New York.
Pre-Existing Conditions
New York health insurance law does not allow insurance companies to deny coverage based on pre-existing conditions. Nor are they allowed to have elimination ryders in their policy to limit coverage on pre-existing conditions. The insurance companies are allowed to have a twelve month exclusion of coverage for pre-existing conditions if the applicants was previously uninsured or had gaps in their coverage. However, after that, the insurance company has to cover costs related to these conditions.
Premium Rates, Renew-ability, and Deni-ability
New York health insurance premium rates are community based. This means the cost is averaged from the size of the community and the number of policy holders. All policies are guaranteed renewable–policies always have the option of renewing coverage for another term. Insurance companies cannot deny coverage for anyone based on age, race, gender, or occupation, neither can the rate be determined based on these. They also cannot terminate policy because of illness.
New York Health Insurance Law for Employees
New York Health Insurance Law covers similar rights for individuals and for employees. In addition to the aforementioned, small group plans have to provide coverage under the parents health insurance for adult children enrolled in school. There are also the COBRA laws which guarantee the right to continued health insurance coverage under the employers health plan after specific events could cause it to lapse.
